Software License Terms – Standalone Edition

These software license terms govern the use of BYB | Bot Protection Pro and the associated software components.

1. Scope

These license terms apply to BYB | Bot Protection Pro Standalone Edition and to all software components, updates and files provided under this license, unless different license terms are expressly specified for a particular version or component.

2. Subject of the License

The licensed software is a digital software product intended to help protect websites and web applications against automated access, bots, abusive requests and other unwanted activity.

The exact functions and system requirements are determined by the product description and the software version available at the time of purchase.

3. Grant of License

After full payment, the customer receives a simple, non-exclusive right to use the software in accordance with these license terms and the respective product description.

The license does not transfer ownership of the software, its source code, trademarks or other intellectual property rights to the customer.

4. License Scope and Authorized Installation

The software may only be installed and used within the scope permitted by the purchased license and the respective product description.

Where a license is limited to a specific website, domain or installation, use beyond that licensed scope requires an additional license unless expressly agreed otherwise.

5. License Key

The license key provided to the customer is assigned to the purchased license and may be used only within the permitted license scope.

The customer must protect the license key against unauthorized access and must not publish or disclose it to third parties except where necessary for the authorized use of the software.

6. Permitted Use

The customer may install, configure and use the software for the intended purpose within the scope of the purchased license.

The customer may create backup copies where this is necessary for the lawful use and safeguarding of the software.

7. Prohibited Use

Except where permitted by mandatory law or expressly authorized by the licensor, the customer may not publish, distribute, reproduce for third parties, sublicense, rent or otherwise make the software or substantial parts of it available to unauthorized third parties.

The software may not be used to develop or distribute an unauthorized competing copy or derivative product based substantially on protected parts of the software.

8. Modification and Technical Adaptation

Changes to configuration files and settings that are intended for customization are permitted within the scope of normal use.

Unauthorized changes to protected program components are made at the customer's own risk and may affect functionality, compatibility, updates or support.

Mandatory statutory rights relating to software, including rights that cannot legally be excluded or restricted, remain unaffected.

9. Updates

Where legally required, updates necessary to maintain the conformity and security of the digital product will be provided for the applicable statutory period.

Additional functional updates, new major versions or new features are included only where expressly stated in the product description, the customer account or the respective offer.

10. Support

Support is provided only to the extent stated in the product description, the offer or the customer account.

Support does not include the administration of third-party systems, the correction of problems caused by unsupported environments or the development of individual custom functions unless separately agreed.

11. System Requirements and Customer Responsibilities

The customer is responsible for ensuring that the system requirements stated for the software are met and that the software is installed and operated in a suitable technical environment.

The customer is responsible for creating appropriate backups before installation, updates or significant configuration changes.

12. Third-Party Software and Components

Third-party software, libraries or components included with or used by the software may be subject to their own license terms. Those license terms remain unaffected.

13. No Guarantee of Complete Protection

The software is designed to reduce and control unwanted automated access and security-related requests. However, no software can guarantee complete protection against every bot, automated request, attack, abuse attempt or future technical threat.

Unless expressly guaranteed, the licensor does not promise that every unwanted request or every automated access attempt will be detected or prevented.

14. Warranty

The statutory warranty rights apply.

Problems caused by unsupported system environments, incompatible third-party extensions, unauthorized changes, incorrect installation or use outside the specified system requirements are not defects for which the licensor is responsible, unless the licensor is responsible for the relevant circumstances.

15. Liability

The licensor is liable without limitation in cases of intent and gross negligence and for damages resulting from injury to life, body or health.

In cases of slight negligence, the licensor is liable only for breach of essential contractual obligations. In such cases, liability is limited to the typical, foreseeable damage.

Any further liability exists only where required by mandatory law.

16. Transfer of the License

Any transfer of the license must comply with the applicable statutory requirements and must not result in unauthorized simultaneous use of the software.

Mandatory statutory rights, including legally applicable exhaustion principles, remain unaffected.

17. Term and End of the Right of Use

The duration of the right of use is determined by the purchased license and the applicable product description.

Upon lawful termination of the right of use, the customer must cease unauthorized use of the software and remove copies to the extent legally required.

18. Copyright and Intellectual Property

The software, its protected program components, documentation, graphics, names and other protected content remain the intellectual property of their respective rights holders.

The customer receives only the rights of use expressly granted by these license terms, the product description and mandatory law.

19. Applicable Law

German law applies. Mandatory consumer protection provisions of the country in which the customer has their habitual residence remain unaffected.

20. Severability

If any provision of these license terms is invalid or unenforceable, the remaining provisions remain unaffected. Statutory provisions apply in place of the invalid provision.

The license terms applicable to an individual purchase are the version accepted at the time of purchase. The applicable version is documented with the purchase and may also be provided to the customer as a PDF.
